1. Accepting these Terms
This document and the other documents that we reference below make up our rules and policies, or what we officially call our Terms of Use for Goods (the “Terms” for short).
The Terms are a legally binding contract between you and Verlocal (the contract is between you and InstQuest, Inc. – InstQuest, Inc. and all of its subsidiaries will be hereby collectively referred to as “Verlocal”).
This contract sets out your rights and responsibilities when you use the services provided by Verlocal (we’ll refer to our website, mobile apps and other services as our “Services”), so please read it carefully. By using any of our Services (even just browsing our website), you’re agreeing to the Terms. If you don’t agree with the Terms, you may not use our Services. Still with us? Great, read on!
2. Those Other Documents We Mentioned
Verlocal’s Services connect people around the world, both online and offline, to make, sell and buy unique goods. Here’s a handy guide to help you understand the specific rules that are relevant for you, depending on how you use the Services:

All of these policies are a part of our Terms, so be sure to read the ones that are relevant for you. Of course, you’ll still want to read the rest of this document because it applies to everyone!
3. Your Privacy
We know your personal information is important to you, so it’s important to us. Our Privacy Policy details how your information is used when you use our Services, and it’s also a part of our Terms, so please read it here.
4. Your Account with Verlocal
You’ll need to create an account with Verlocal to use our Services. Here are a few rules about accounts with Verlocal:
A. You must be 18 or older to use our Services. Otherwise, you may only use our Services under the supervision of a parent or legal guardian.
B. Be honest with us. Provide accurate information about yourself. It’s not OK to use false information or impersonate another person or company through your account.
C. You are responsible for your account. You’re solely responsible for any activity on your account. If you’re sharing an account with other people, then the person whose billing information is on the account will ultimately be responsible for all activity. If you’re registering as a business entity, you personally guarantee that you have the authority to agree to the Terms on behalf of the business. Also, your accounts are not transferable.
D. Protect your password. As we mentioned above, you’re solely responsible for any activity on your account, so it’s important to keep your account password secure.
E. Let’s be clear about our relationship. These Terms don’t create any agency, partnership, joint venture, employment or franchisee relationship between you and Verlocal.
5. Your Content
Content that you post using our Services is your content (so let’s refer to it as “Your Content”). We don’t make any claim to it. That includes anything you post using our Services (like usernames, profile pictures, listing photos, listing descriptions, reviews, comments, videos, etc.).
A. Responsibility for Your Content. You understand that you are solely responsible for Your Content. You represent that you have all necessary rights to Your Content and that you’re not infringing or violating any third party’s rights by posting it.
B. Permission to Use Your Content. By posting Your Content through our Services, you grant Verlocal a license to use it. We don’t claim any ownership to Your Content, but we have your permission to use it to help Verlocal function and grow. That way, we won’t infringe any rights you have in Your Content and we can help promote your stuff.
C. Rights You Grant Verlocal. (Here’s the legalese version of the last section). By posting Your Content, you grant Verlocal a non-exclusive, worldwide, royalty-free, irrevocable, sub-licensable, perpetual license to use, display, edit, modify, reproduce, distribute, store, and prepare derivative works of Your Content to provide the Services and to promote Verlocal, your Verlocal pages, or the Services in general, in any formats and through any channels, including across any Verlocal Services or third-party website or advertising medium.
That sounds like a lot, but it’s necessary for us to keep Verlocal going. Consider these examples: if you upload a photo of an item on your Verlocal listing, first, we have permission to display it to buyers, and second, we can resize it so it looks good to a buyer using our mobile app; if you post a description in English, we can translate it into French so a buyer in Paris can learn the story behind your item; and if you post a beautiful photo of your latest handmade necklace, we can feature it on our homepage, in one of our blogs or even on a billboard to help promote your business and Verlocal’s.
D. Reporting Unauthorized Content. Verlocal has great respect for intellectual property rights, and is committed to following appropriate legal procedures to remove infringing content from the Services. If content that you own or have rights to has been posted to the Services without your permission and you want it removed, please contact us at [email protected]. If Your Content infringes another person’s intellectual property, we will remove it if we receive proper notice. We’ll notify you if that happens.
E. Inappropriate, False or Misleading Content. This should be common sense, but there are certain types of content we don’t want posted on Verlocal’s Services (for legal reasons or otherwise). You agree that you will not post any content that is abusive, threatening, defamatory, obscene, vulgar or otherwise offensive or in violation of any part of our Terms. You also agree not to post any content that is false and misleading or uses the Services in a manner that is fraudulent or deceptive.
6. Your Use of Our Services
License to Use Our Services. We grant you a limited, non-exclusive, non-transferable and revocable license to use our Services—subject to the Terms and the following restrictions in particular:
A. Don’t Use Our Services to Break the Law. You agree that you will not violate any laws in connection with your use of the Services. This includes any local, state, federal and international laws that may apply to you. For example, it’s your responsibility to obtain any permits or licenses that you, as a merchant, require;you may not sell anything that violates any laws; and don’t commit fraud, theft or any other crimes against Verlocal, another Verlocal user or a third party.
B. Don’t Steal Our Stuff. You agree not to “crawl,” “scrape,” or “spider” any page of the Services or to reverse engineer or attempt to obtain the source code of the Services.
C. Don’t Try to Harm Our Systems. You agree not to interfere with or try to disrupt our Services, for example by distributing a virus or other harmful computer code.
D. Share Your Ideas. We love your suggestions and ideas! They can help us improve your experience and our Services. Any unsolicited ideas or other materials you submit to Verlocal (not including Your Content or items you sell through our Services) are considered non-confidential and non-proprietary to you. You grant us a non-exclusive, worldwide, royalty-free, irrevocable, sub-licensable, perpetual license to use and publish those ideas and materials for any purpose, without compensation to you.
7. Termination
Termination By You. We hate to see you go, but you may terminate your account with Verlocal at any time from your account settings. Terminating your account will not affect the availability of some of Your Content that you posted through the Services prior to termination.
Termination By Verlocal. We may terminate or suspend your account (and any related accounts) and your access to the Services at any time, for any reason, and without advance notice. If we do so, it’s important to understand that you don’t have a contractual or legal right to continue to use our Services, for example, to sell or buy on our website or mobile apps. Verlocal may refuse service to anyone, at any time, for any reason.
If you or Verlocal terminates your account, you may lose any information associated with your account, including Your Content.
We May Discontinue the Services. Verlocal reserves the right to change, suspend or discontinue any of the Services at any time, for any reason. We will not be liable to you for the effect that any changes to the Services may have on you, including your income or your ability to generate revenue through the Services.
Survival. The Terms will remain in effect even after your access to the Service is terminated, or your use of the Service ends.
8. Warranties and Limitation of Liability (or the Things You Can’t Sue Us For)
Items You Purchase. You understand that Verlocal does not manufacture, store or inspect any of the items sold through our Services. We provide the venue; the items in our marketplace are produced and sold directly by independent sellers, so Verlocal cannot and does not make any warranties about their quality, safety or even their legality. Any legal claim related to an item you purchase must be brought directly against the seller of the item. You release Verlocal from any claims related to items sold through our Services, including for defective items, misrepresentations by sellers or items that caused physical injury (like product liability claims).
Content You Access. You may come across materials that you find offensive or inappropriate while using our Services. We make no representations concerning any content posted by users through the Services. Verlocal is not responsible for the accuracy, copyright compliance, legality or decency of content posted by users that you accessed through the Services. You release us from all liability relating to that content.
People You Interact With. You can use the Services to interact with other individuals, either online or in person. However, you understand that we do not screen users of our Services, and you release us from all liability relating to your interactions with other users. Please be careful and exercise caution and good judgment in all interactions with others, especially if you are meeting someone in person.
Third-Party Services. Our Services may contain links to third-party websites or services that we don’t own or control (for example, links to Facebook, Twitter, and Pinterest). You may also need to use a third party’s product or service in order to use some of our Services (like a compatible mobile device to use our mobile apps). When you access these third-party services, you do so at your own risk. The third parties may require you to accept their own terms of use. Verlocal is not a party to those agreements; they are solely between you and the third party.
Warranties. Verlocal is dedicated to making our Services the best they can be, but we’re not perfect and sometimes things can go wrong. You understand that our Services are provided “as is” and without any kind of warranty (express or implied). We are expressly disclaiming any warranties of title, non-infringement, merchantability and fitness for a particular purpose, as well as any warranties implied by a course of performance, course of dealing or usage of trade.
We do not guarantee that: (i) the Services will be secure or available at any particular time or location; (ii) any defects or errors will be corrected; (iii) the Services will be free of viruses or other harmful materials; or (iv) the results of using the Services will meet your expectations. You use the Services solely at your own risk. Some jurisdictions do not allow limitations on implied warranties, so the above limitations may not apply to you.
Liability Limits. To the fullest extent permitted by law, neither Verlocal, nor our employees or directors shall be liable to you for any lost profits or revenues, or for any consequential, incidental, indirect, special or punitive damages arising out of or in connection with the Services or these Terms. In no event shall Verlocal’s aggregate liability for any damages exceed the greater of one hundred ($100) US Dollars or the amount you paid Verlocal in the past twelve months. Some jurisdictions do not allow limitations on incidental or consequential damages, so the above limitations may not apply to you.
Indemnification (or What Happens If You Get Us Sued)
We hope this never happens, but if Verlocal gets sued because of something that you did, you agree to defend and indemnify us. That means you’ll defend Verlocal (including any of our employees) and hold us harmless from any legal claim or demand (including reasonable attorney’s fees) that arises from your actions, your use (or misuse) of our Services, your breach of the Terms or your account’s infringement of someone else’s rights.
We reserve the right to handle our legal defense however we see fit, even if you are indemnifying us, in which case you agree to cooperate with us so we can execute our strategy.
10. Disputes with Other Users
If you find yourself in a dispute with another user of Verlocal’s Services or a third party, we encourage you to contact the other party and try to resolve the dispute amicably.
You can also contact us at [email protected] with any grievances. Verlocal will attempt to help you resolve disputes in good faith and based solely on our interpretation of our policies, in our sole discretion; we will not make judgments regarding legal issues or claims. Verlocal has no obligation to resolve any disputes.
Release of Verlocal. You release Verlocal from any claims, demands and damages arising out of disputes with other users or parties.
If you find yourself in a dispute with another user of Verlocal’s Services or a third party, we encourage you to contact the other party and try to resolve the dispute amicably.

Verlocal will attempt to help you resolve disputes in good faith and based solely on our interpretation of our policies, in our sole discretion; we will not make judgments regarding legal issues or claims. Verlocal has no obligation to resolve any disputes.
Release of Verlocal. You release Verlocal from any claims, demands and damages arising out of disputes with other users or parties.
11. Disputes with Verlocal
If you’re upset with us, let us know, and hopefully we can resolve your issue. But if we can’t, then these rules will govern any legal dispute involving our Services:
A. Governing Law. The Terms are governed by the laws of the State of California, without regard to its conflict of laws rules, and the laws of the United States of America. These laws will apply no matter where in the world you live or are currently situated.
B. Arbitration. You and Verlocal agree that any dispute or claim arising from or relating to the Terms shall be finally settled by arbitration, using the English language, administered by the American Arbitration Association (the “AAA”) under its Commercial Arbitration Rules then in effect (those rules are deemed to be incorporated by reference into this section). Our arbitration will be handled by a sole arbitrator in accordance with those rules. Judgment on the arbitration award may be entered in any court that has jurisdiction. Any arbitration under the Terms will take place on an individual basis: class arbitrations and class actions are not permitted. You understand that by agreeing to the Terms, you and Verlocal are each waiving the right to trial by jury or to participate in a class action. Notwithstanding the foregoing, each party shall have the right to bring an action in a court of proper jurisdiction for injunctive or other equitable or conservatory relief, pending a final decision by the arbitrator.
C. Forum. We’re based in San Francisco, California, so any legal action against Verlocal related to our Services must be filed and take place in San Francisco. That means the seat of any arbitration shall be San Francisco. For any actions not subject to arbitration, you and Verlocal agree to submit to the personal jurisdiction of a state court located in San Francisco County, California or the United States District Court for the Northern District of California.
If you are a government agent or entity in the United States using the Services in your official capacity, and you are legally unable to agree to the clauses in this section, then those clauses do not apply to you. In that case, the Terms and any action related to the Terms will be governed by the laws of the United States (without reference to conflict of laws) and, in the absence of federal law and to the extent permitted under federal law, the laws of the State of California.
12. Changes to the Terms
We may update these Terms from time to time. If we believe that the changes are material, we’ll definitely let you know by doing one (or more) of the following: (1) posting the changes through the Services or (2) sending you an email or message about the changes. That way you can decide whether you want to continue using the Services. Changes will be effective upon the posting of the changes. You are responsible for reviewing and becoming familiar with any changes. Your use of the Services following the changes constitutes your acceptance of the updated Terms.
13. Some Finer Legal Points
The Terms, including all of the policies that make up the Terms, supersede any other agreement between you and Verlocal regarding the Services. If any part of the Terms is found to be unenforceable, that part will be limited to the minimum extent necessary so that the Terms will otherwise remain in full force and effect. Our failure to enforce any part of the Terms is not a waiver of our right to later enforce that or any other part of the Terms. We may assign any of our rights and obligations under the Terms.

Seller Policy
Verlocal is a marketplace where you can sell your handmade goods and craft supplies directly to buyers in the US. We want to make sure that you and your buyers have a positive experience on Verlocal. Please read on to find out more about your rights, as well as what is expected of you, as a seller.
This policy is a part of our Terms of Use. By becoming a Verlocal merchant, you’re agreeing to this policy and our Terms of Use.
What Can be Sold on Verlocal
Verlocal is a unique marketplace. Buyers come to Verlocal to purchase items that they might not find anywhere else. Everything listed for sale on Verlocal must be handmade, homemade, or a craft supply.
Handmade and homemade items are items that are made or designed by you, the seller.
You must be able to demonstrate that your items comply with the following:
1. All handmade and homemade items are made or designed by you.
2. You are using your own photographs– not stock photos, artistic renderings, or photos used by other sellers or sites.
If you are selling Custom Items, you agree that:
1. All custom item listings are available for purchase. 2. Each custom listing has a set price. 3. If you are using photographs of previous work with options for customization (like color choices) included in the listing, it is clear in your description that the photos shown are just examples. Craft Supplies are tools, ingredients, or materials intended for use in the creation of a new handmade item. Commercially made materials that are ready to use as finished goods may not be sold as craft supplies on Verlocal.
What Can’t be Sold on Verlocal
Even if they otherwise meet our handmade, homemade, or craft supply criteria, prohibited items, services, and items that violate our intellectual property policies are not allowed to be sold on Verlocal.
Reselling is not allowed on Verlocal. Reselling refers to selling an item when you were not involved in the creation process. In short, you may not resell items that you were not involved in designing or making.
Keep in mind that members may flag listings that appear to violate our policies for Verlocal’s review.
Verlocal may remove any listings that violate our policies. Verlocal may also suspend or terminate your account for any violations.
Representing Yourself and Your Listings Honestly
One of Verlocal’s core values is transparency. Transparency means that you honestly and accurately represent yourself, your items, and your business.
By selling on Verlocal, you agree that you will:
1. Provide honest, accurate information in your biography, should you choose to complete it.
2. Honor your policies, should you choose to publish them.
3. Accurately represent your items in listings and listing photos.
4. Respect the intellectual property of others. If you feel someone has violated your intellectual property rights, you can email us at [email protected].
5. Not engage in fee avoidance.
6. Not create duplicate accounts.
Communicating with Other Verlocal Members
Messages
You can use Verlocal messaging (“messages”) to communicate directly with your buyers or other Verlocal members. Conversations by messages are a great way for buyers to ask you questions about an item or an order.
Messaging may not be used for the following activities:
1. Sending unsolicited advertising or promotions, requests for donations, or spam;
2. Harassing or abusing another member;
3. Contacting someone after they have explicitly asked you not to; or
4. Interfering with a transaction or the business of another member.
Interference
Interference occurs when a member intentionally interferes with another member in order to drive away their business. Interference is strictly prohibited on Verlocal. Examples of interference include:
1. Contacting another member via messages to warn them away from a particular member or item
2. Posting in public areas to demonstrate or discuss a dispute with another member
3. Purchasing from a seller for the sole purpose of leaving a negative review.
Harassment
Any use of Verlocal messages to harass other members is strictly prohibited. Similarly, messages may not be used to support or glorify hatred toward, or otherwise demean people based upon: race, ethnicity, religion, gender, gender identity, disability, or sexual orientation. If you receive a message that violates this policy, please let us know right away.
Emails
You may receive a buyer’s email address or other information as a result of entering into a transaction with that buyer. This information may only be used for Verlocal-related communications or for Verlocal-facilitated transactions. You may not use this information for unsolicited commercial messages or unauthorized transactions. Without the buyer’s explicit consent, you may not add any Verlocal member to your email or physical mailing list or store or misuse any payment information.
Creating and Uploading Content
As a member of Verlocal, you have the opportunity to create and upload a variety of content, like usernames, listings, messages, text, photos, and videos. In order to keep our community safe and respectful, you agree that you will not upload content that is:
1. Abusive, threatening, defamatory, or harassing;
2. Obscene or vulgar;
3. In violation of someone else’s privacy or intellectual property rights; or
4. False, deceptive, or misleading.
Building a Positive Reputation Through our Reviews System
Reviews are a great way for you to build a reputation on Verlocal. Buyers can leave a review, including a one to five star rating and a photograph of their purchase.
On the rare occasion you receive an unfavorable review, you can reach out to the buyer.
Reviews and your response to reviews may not:
1. Contain private information;
2. Contain obscene, racist, or harassing language or imagery;
3. Contain medical drug claims;
4. Contain advertising or spam;
5. Be about things outside the seller’s control, such as a shipping carrier, Verlocal or a third party; or
6. Undermine the integrity of the Reviews system.
Extortion
Extortion is not allowed on Verlocal. Any attempt to manipulate reviews through threats, intimidation, or bribery is considered extortion and is strictly prohibited on Verlocal. Extortion includes when a seller offers a buyer additional goods, services, or compensation in exchange for a positive review.
Shilling
Shilling is strictly prohibited on Verlocal. Shilling is the fraudulent inflation of a merchant’s reputation by use of an alternate account. The intent of shilling is to make a merchant look more desirable by increasing the merchant’s number of sales and overall review score. Not only does it violate our core value of transparency, but it is considered to be a deceptive business practice by the US Federal Trade Commission. Reviews must reflect the honest, unbiased opinions, findings, beliefs, or experience of the buyer.
Providing Great Customer Service
We expect our sellers to provide a high level of customer service. By selling on Verlocal, you agree to:
1. Honor your shipping and processing times. Sellers are obligated to ship an item or otherwise complete a transaction with a buyer in a prompt manner, unless there is an exceptional circumstance.
2. Respond to messages in a timely manner.
3. Honor the commitments you make in your policies.
4. Resolve disagreements or disputes directly with the buyer. In the unlikely event that you can’t reach a resolution, our team can help.
5. If you are unable to complete an order, you must notify the buyer and cancel the order.
Responding to Requests for Cancellations, Returns, and Exchanges
Cancellations
If you are unable to complete a transaction, you must notify the buyer via Verlocal messages and cancel the transaction. If the buyer already submitted payment, you must agree to issue a full refund. You are encouraged to keep proof of any refunds in the event a dispute arises.
You may cancel a transaction under the following circumstances:
1. The buyer did not pay. (The seller may flag a buyer for a payment not received, chargeback, or canceled payment.)
2. Both you and the buyer agree to cancel the transaction prior to shipment, and you have issued the buyer a full refund.
3. You have decided to refuse service to the buyer, and if the buyer has already paid, you have issued a full refund, including shipping.
4. The buyer did not receive the item(s) ordered, even though you provided proof of shipping, and you have agreed to issue a refund for the item.
5. Both you and the buyer agreed that the buyer could return the item for a refund, you have received the returned item and issued a refund to the buyer for the item.
Verlocal’s Dispute System
We ask buyers to contact a seller directly and attempt to resolve any outstanding issues before opening a case with Verlocal. For this reason, it is important that you publish your policies and regularly respond to messages from your buyers.
Buyers may file a case for a non-delivery or a not-as-described item. You must respond to any open cases within seven days.
A Non-Delivery occurs when a buyer places an order and submits payment, but does not receive the item. The following are examples of Non-Delivery cases:
1. An item was never sent.
2. An item was sent to an address that is not on the Verlocal receipt.
3. There is no proof that the item was shipped to the buyer’s address.
An item is Not as Described if it is materially different from the your listing description or your photos. The following are examples of Not as Described cases:
1. The item received is a different color, model, version, or size than is shown in the photo or described in the listing.
2. The item has a different design or material.
3. The item was advertised as authentic but is not authentic.
4. You failed to disclose the fact that an item is damaged or is missing parts.
5. A buyer purchased three items but only received two.
6. The condition of the item is misrepresented. For example, the description at the time of purchase said the item was “new” and the item is used.
The above listed Not as Described scenarios do not encompass all possible scenarios. Not as Described cases can also be filed for late delivery. In order to qualify as late delivery, the buyer must provide proof that all of these conditions have been met:
1. The item(s) were ordered for a specific date or event.
2. A deadline was agreed upon by the buyer and seller.
3. The item(s) are rendered useless after that date.
Prohibited Items Policy
Verlocal is not a curated marketplace. However, for a variety of reasons, we prohibit certain types of items from the Verlocal marketplace. Some items present legal risks to our community; others are inconsistent with our values, are harmful to our members, or simply are not in the spirit of Verlocal. This policy explains what is prohibited or restricted on Verlocal. This policy is a part of our Terms of Use. By becoming a merchant on Verlocal, you’re agreeing to this policy and our Terms of Use.
The following types of items are prohibited or restricted on Verlocal:
1. Alcohol, Tobacco, Drugs, Drug Paraphernalia, and Medical Drug Claims
2. Animals and Certain Animal Products
3. Dangerous Items: Hazardous Materials, Recalled Items, and Weapons
4. Hate Items: Items that Promote, Support, or Glorify Hatred
5. Illegal Items, Items Promoting Illegal Activity, and Highly Regulated Items
6. Internationally Regulated Items
7. Pornography and Mature Content
8. Violent Items: Items that Promote, Support, or Glorify Violence
Policy decisions are complex. We consider many different and often divergent factors before coming to a decision about what is best for our community. Because we are a creative community, we err on the side of freedom of expression. We also tend to allow items that have educational, historical, or artistic value, but we know that even those items are subject to a variety of valid and sometimes conflicting interpretations and emotional responses.
Art and history can be provocative, emotional, and divisive. There are some topics on which we may never reach a consensus as a community, and that is okay. In the words of Joyce Carol Oates, “art should not be comforting; for comfort, we have mass entertainment and one another. Art should provoke, disturb, arouse our emotions, expand our sympathies in directions we may not anticipate and may not even wish.”
In order to help provide clarity and insight into our policy making process, we have included the rationale behind our decisions and details about how they will be enforced, including some representative examples below of what is allowed on Verlocal.
1. Alcohol, Tobacco, Drugs, Drug Paraphernalia, and Medical Drug Claims
Alcohol and drugs are prohibited on Verlocal. These substances face serious legal restrictions and in many cases are considered controlled substances under applicable law. Our policy also applies to other substances that have or claim to have an intoxicating or healing effect. Possible legal restrictions aside, these substances simply are not in the spirit of Verlocal and we therefore do not allow them.
More Details:
The following are examples of items that may not be sold on Verlocal:
1. Alcohol
2. Tobacco products, smokeable products, e-cigarettes, and e-liquid.
3. Drugs and certain intoxicating herbal substances, including substances used for recreational and medicinal purposes, regardless of their legality.
4. Drug paraphernalia, including, for example: items with a carburetor; slides and/or items with a slide; bongs and bubblers; vaporizers and their components.
5. Medical drugs or listings that contain medical drug claims. Medical Drug claims are statements that claim a causal relationship between a substance and the prevention, healing, or treatment of a physical condition or disease. A listing must not make such claims in the presentation of an item, including the title, description, tags, or images in the listing.
Examples of What is Allowed:

Beyond that, we restrict mature content so that people who are offended by this kind of material don’t have to see it. If you are selling mature content, we ask that you understand that there are differing sensibilities around the world and that you try to be respectful.

Fees & Payments Policy
Sellers may be charged for using some of Verlocal’s services. This Fees & Payments Policy explains your fees, taxes, and how to get paid.
This policy is a part of our Terms of Use. By becoming a merchant on Verlocal, you’re agreeing to this policy and our Terms of Use.
1. Types of Fees
Sellers may be required to pay the following types of fees:
Transaction Fees
When you make a sale through Verlocal, you will be charged a transaction fee of 3.5% of the item price. This percentage does not apply to the shipping cost or tax. Transaction fees will be deducted when you are paid out to by Verlocal.
Payment Processing Fees
When you make a sale through Verlocal, along with the transaction fee, you will also be charged a payment processing fee of 3.0%. This percentage does not apply to the shipping cost or tax. Payment processing fees will also be deducted when you are paid out to by Verlocal.
Shipping Fees
Shipping method and cost are both decided and handled by the seller. The cost of the shipping label will depend on the origin and destination and weight and size of the package. If you add signature confirmation or insurance, those fees will be added to the total cost of the label at the point of purchase. Sellers may also purchase parcel insurance through licensed insurance carriers. You will be able to enter the cost of shipping when creating a listing for an item. The shipping fee will be included in the total checkout price of the guest and paid out to you along with the rest of the payment of selling the item.

2. Fee Avoidance
Any action by a seller to avoid paying a fee is considered fee avoidance and is strictly prohibited by Verlocal. This includes, for example, encouraging buyers to purchase an item on your Verlocal profile through another venue. The price stated in each listing description must be an accurate representation of the sale. Sellers may not charge excessive shipping fees. Sellers may not alter the item’s price after a sale for the purpose of avoiding Verlocal transaction fees, misrepresent the item’s location, or use another user’s account without permission.
3. Getting Paid
Verlocal will pay you once you have marked the item as being shipped. Please make sure that a payment method has been added to the payment page under “Payout.”.
4. Taxes
You are responsible for collecting and paying any taxes associated with using and making sales through Verlocal’s services. Verlocal will issue 1099-K forms to certain sellers in the United States to comply with IRS requirements.

E. Shipping to the wrong address is likely to result in a non-delivery case, so make sure to ship to the address listed on the Verlocal receipt or sent to you by the buyer through a Verlocal message.
F. Mark the order as shipped when you ship it. Remember that you may only mark an order as shipped after you actually have shipped it. When you mark an order as shipped, the buyer will receive a Verlocal Shipping Notification.
G. Charge an appropriate amount for shipping.
By entering tracking information on Verlocal, you’re giving us permission to collect and share the tracking information received from your chosen shipping carrier with the buyer.
In the unlikely event an order does not arrive, be prepared to provide valid proof of shipping. Valid proof of shipping must show that the item actually was shipped and that it was sent to the address provided by the buyer (or verified via USPS address verification). If a buyer does not receive their order, they may file a case against you.

When you buy from a merchant on Verlocal, you’re directly supporting an independent business, each with its unique listings, processing times, and shipping preferences. By making a purchase from a seller on Verlocal, you agree that you:

Leaving a Review of an Item
Reviews are a great way to learn about a seller’s items and reputation, help good sellers build a strong reputation, or help warn other buyers about a poor experience.
You can leave a review, including a one to five star rating and a photograph of your purchase.
By leaving a review or photograph, you acknowledge that:
Your review and/or photograph and profile information will be publicly displayed on the seller’s listing page.
Reviews and photographs may not:
Contain private information;
Contain obscene, racist, or harassing language or imagery;
Contain medical drug claims;
Contain advertising or spam;
Be about things outside the seller’s control, such as a shipping carrier, Verlocal, or a third party; or
Undermine the integrity of the Reviews system.
Extortion is not allowed on Verlocal. Any attempt to manipulate reviews through threats, intimidation, or bribery is considered extortion and is strictly prohibited on Verlocal. Examples of extortion include the following:
A buyer leaves a negative review in an attempt to force the seller into providing additional items that were not agreed upon in the original transaction.
A buyer leaves a negative review in an attempt to force the seller into providing a refund when a refund is not warranted.
Shilling is not allowed on Verlocal.. Shilling is the fraudulent inflation of a merchant’s reputation by use of an alternate account. The intent of shilling is to make a seller look more desirable by increasing the merchant’s number of sales and overall review score. Not only does it violate our core value of transparency, but it is considered to be a deceptive business practice by the US Federal Trade Commission. Reviews must reflect the honest, unbiased opinions, findings, beliefs, or experience of the buyer.
By uploading a photograph to Verlocal’s website or mobile app, you warrant that:
You own the photograph or you have the rights or permission to use the photograph; and
You understand that, as stated in Verlocal’s Terms of Use, Verlocal has license to use any content you provide to Verlocal.
Sellers may report reviews that violate our Terms of Use.
We reserve the right to remove reviews or photographs that violate our policies or Terms of Use.

Creating and Uploading Content
As a member of Verlocal, you have the opportunity to create and upload a variety of content, like URLs, messages, text, photos, and videos. In order to keep our community safe and respectful, you agree that you will not upload content that is:
Abusive, threatening, defamatory, or harassing;
Obscene or vulgar;
In violation of someone else’s privacy or intellectual property rights; or
False, deceptive, or misleading.

Reporting a Problem with an Order or Returning an Item
Disputing an Order on Verlocal
Although Verlocal is not directly involved in a transaction between a buyer and a seller, we may decide to assist you in the unlikely event your purchase from a seller does not go as expected. If an issue cannot be resolved through contacting the seller directly, you can contact [email protected], for example in the event of a non-delivery, or if an item you receive is not as described in the listing. You can contact us to report an issue under the following circumstances:
Non-Delivery
A Non-Delivery occurs when a buyer places an order and submits payment, but the seller does not ship the item or does not ship the item to the correct address. The following are examples of Non-Delivery cases:
An item was never sent.
An item was sent to an address that is not on the Verlocal receipt or was not verified through convos or USPS address verification.
There is no proof that the item was shipped to the buyer’s address.
Not-as-Described
An item is Not as Described if it is materially different from the seller’s listing description or photos. Here are a few examples of Not as Described cases:
The item received is a different color, model, version, or size.
The item has a different design or material.
The item was advertised as authentic but is not authentic.
The seller failed to disclose the fact that an item is damaged or is missing parts.
A buyer purchased three items but only received two.
The condition of the item is misrepresented. For example, the description at the time of purchase said the item was “new” and the item is used.
Not as Described cases can also be filed for late delivery. In order to qualify as late delivery, the buyer must provide proof that all of these conditions have been met:
The item(s) were ordered for a specific date or event.
A deadline was agreed upon by the buyer and seller.
The item(s) are rendered useless after that date.
Ineligible Transactions
The following are not eligible for dispute on Verlocal:
Items that have been purchased in person
Intangible items, services, or prohibited items
Transactions where payment is not made through Verlocal’s platform
Items that are returned without a return agreement
Items that have been altered, used, worn, or washed after receiving them
Physical or tangible items that are not available for return because they have been destroyed or discarded by the buyer
Items that are received after the agreed-upon delivery date due to shipping delays
Cancelled transactions that have already resulted in a refund

Requesting a Cancellation
Only sellers may cancel transactions. Buyers may request that a seller cancel an order.
Returning an Item
Verlocal has a general, marketplace-wide no return policy unless Verlocal’s policy has been violated by the seller. However, the merchant may agree to accept a return at their own discretion.
